Terms and Conditions
1. Agreement
These Terms and Conditions ("Terms"), together with the accepted Styling Proposal, constitute the entire agreement ("Agreement") between Deco Property Styling Pty Ltd ("Deco", "we", "our", "us") and the person, corporation, trust, or partnership ("Hirer", "you", "your") named in the Styling Proposal. This Agreement commences upon your acceptance of the Styling Proposal.
2. Ownership and Title
All items including furniture, accessories, artworks, and goods supplied by Deco remain our exclusive property at all times. You must not sell, assign, pledge, sublease, lend, move, or otherwise part with possession without our explicit written consent.
3. Hire Period
3.1 The hire period commences from the date of delivery and installation and continues for the minimum rental period specified in the Styling Proposal ("Minimum Hire Period").
3.2 Early return of the Goods does not entitle you to any refund or credit.
3.3 Following the Minimum Hire Period, hire automatically continues weekly until we receive at least three business days’ written notice requesting collection.
4. Hire Fees and Payment
4.1 Hire fees are as detailed in the Styling Proposal and must be paid in full prior to delivery and installation.
4.2 Payments may be made via credit card, debit card, or EFT. Any applicable surcharges will be detailed in the Styling Proposal.
4.3 Overdue payments attract interest at a rate of 1.5% per month, calculated daily from the due date until payment is received.
5. Cancellation and Rescheduling
5.1 Cancellations or rescheduling within three business days prior to delivery incur a fee equivalent to one week's hire. Same-day cancellations or rescheduling incur a fee equal to one week's hire plus applicable delivery charges.
6. Delivery, Installation, and Collection
6.1 Delivery and collection are scheduled during business hours (9 am to 3 pm, Monday to Friday). Additional charges apply for after-hours services.
6.2 You must ensure safe and clear access to your premises. Delays or failure to provide access will incur additional charges of $160 per hour after an initial 30-minute grace period.
6.3 Deco stylists select Goods at their professional discretion. Requests to swap Goods due to personal preference incur a swap fee of $600 plus GST, plus additional delivery charges.
6.4 Deco may use professional hanging methods (nails, screws, or hooks) to install artwork and mirrors. We are not liable for minor wall damage and will not patch, repair, or repaint these areas.
6.5 Deco will not move or rearrange your existing furniture. You must arrange removal or relocation prior to installation.
7. Hirer’s Obligations
7.1 You must keep all Goods secure and protected from theft, loss, or damage, and not remove them from the specified location without prior approval.
7.2 Notify us immediately of any loss, theft, or damage to the Goods.
7.3 You must insure the Goods for their full replacement value against theft, fire, and damage throughout the hire period.
8. Damage, Loss, and Cleaning
8.1 You are responsible for any loss, theft, or damage beyond fair wear and tear, and must reimburse Deco for repair costs or replacement value as determined by Deco.
8.2 You will be charged for professional cleaning if Goods are returned in an excessively dirty or soiled condition.
9. Termination
Deco may terminate this Agreement immediately if you breach any terms, fail to make timely payments, or enter insolvency. Deco may repossess Goods without notice, and you must provide access for collection. You indemnify Deco for costs incurred in repossession.
10. Indemnity and Liability
10.1 You indemnify Deco against all liabilities, claims, losses, and expenses arising from the use, loss, damage, or theft of Goods, except where directly attributable to Deco’s negligence.
10.2 Deco's liability is limited to the hire fees paid under this Agreement. Deco is not liable for indirect, consequential, or special damages.
11. Privacy
Your personal information will be managed according to the Privacy Act 1988 (Cth). Deco may disclose your information to credit reporting agencies as permitted by law.
12. Force Majeure
Deco is not liable for delays or failures resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, or labor disputes.
13. PPSA (Personal Property Securities Act)
13.1 You acknowledge Deco has a security interest under the PPSA over all Goods supplied.
13.2 You agree to provide all assistance necessary to enable Deco to register and enforce this security interest, including executing documents or providing required information.
14. General
14.1 These Terms are governed by the laws of New South Wales, Australia.
14.2 Any amendments must be in writing and agreed upon by both parties.
14.3 Should any clause be deemed unenforceable, it shall be modified or severed without affecting other provisions.
14.4 Deco may assign this Agreement without notice. You may not assign without Deco’s prior written consent.
15. GST
All fees quoted exclude GST, which will be added and detailed in tax invoices.
By accepting the Styling Proposal, you confirm your understanding of and agreement to all conditions detailed herein.
